AMD files antitrust lawsuit against Intel in US federal district court

AMD filed an antitrust complaint against Intel Corporation two days ago in U.S. federal district court for the district of Delaware under Section 2 of the Sherman Antitrust Act, Sections 4 and 16 of the Clayton Act, and the California Business and Professions Code.

According to the complaint, Intel has unlawfully maintained its monopoly by, among other things:

  • Forcing major customers such as Dell, Sony, Toshiba, Gateway, and Hitachi into Intel-exclusive deals in return for outright cash payments, discriminatory pricing or marketing subsidies conditioned on the exclusion of AMD;
  • According to industry reports, and as confirmed by the JFTC in Japan, Intel has paid Dell and Toshiba huge sums not to do business with AMD.
  • Intel paid Sony millions for exclusivity. AMD’s share of Sony’s business went from 23 percent in ‘02 to 8% in ‘03, to 0%, where it remains today.
  • Forcing other major customers such as NEC, Acer, and Fujitsu into partial exclusivity agreements by conditioning rebates, allowances and market development funds (MDF) on customers’ agreement to severely limit or forego entirely purchases from AMD;
  • Intel paid NEC several million dollars for caps on NEC’s purchases from AMD. Those caps assured Intel at least 90% of NEC’s business in Japan and imposed a worldwide cap on the amount of AMD business NEC could do.
  • Establishing a system of discriminatory and retroactive incentives triggered by purchases at such high levels as to have the intended effect of denying customers the freedom to purchase any significant volume of processors from AMD;
  • When AMD succeeded in getting on the HP retail roadmap for mobile computers, and its products sold well, Intel responded by withholding HP’s fourth quarter 2004 rebate check and refusing to waive HP’s failure to achieve its targeted rebate goal; it allowed HP to make up the shortfall in succeeding quarters by promising Intel at least 90% of HP’s mainstream retail business.
  • Threatening retaliation against customers for introducing AMD computer platforms, particularly in strategic market segments such as commercial desktop;
  • Then-Compaq CEO Michael Capellas said in 2000 that because of the volume of business given to AMD, Intel withheld delivery of critical server chips. Saying “he had a gun to his head,” he told AMD he had to stop buying.
  • According to Gateway executives, their company has paid a high price for even its limited AMD dealings. They claim that Intel has “beaten them into ‘guacamole’” in retaliation.
  • Establishing and enforcing quotas among key retailers such as Best Buy and Circuit City, effectively requiring them to stock overwhelmingly or exclusively, Intel computers, artificially limiting consumer choice;
  • AMD has been entirely shut out from Media Markt, Europe’s largest computer retailer, which accounts for 35 percent of Germany’s retail sales.
  • Office Depot declined to stock AMD-powered notebooks regardless of the amount of financial support AMD offered, citing the risk of retaliation.
  • Forcing PC makers and tech partners to boycott AMD product launches or promotions;
  • Then-Intel CEO Craig Barrett threatened Acer’s Chairman with “severe consequences” for supporting the AMD Athlon 64 launch. This coincided with an unexplained delay by Intel in providing $15-20M in market development funds owed to Acer. Acer withdrew from the launch in September 2003.
  • Abusing its market power by forcing on the industry technical standards and products that have as their main purpose the handicapping of AMD in the marketplace.
  • Intel denied AMD access to the highest level of membership for the Advanced DRAM technology consortium to limit AMD’s participation in critical industry standard decisions that would affect its business.
  • Intel designed its compilers, which translate software programs into machine-readable language, to degrade a program’s performance if operated on a computer powered by an AMD microprocessor.

Election in Moldova instigates rioting mob demanding recount

Protests which began Monday escalated to a riot on Wednesday consisting of over 10,000 people in Chi?in?u, the capital of Moldova, protesting the results of Sunday’s 2009 Moldovan parliamentary election, which showed an apparent, narrow victory for the Communist Party (Partidul Comuni?tilor din Republica Moldova, PCRM). Demonstrators claim the victory was the result of electoral fraud.

The demonstration escalated to a “flash mob” of between 10,000 to 15,000 communicating via online tools like email, micro-blogging tool Twitter, and social-networking website Facebook. “We sent messages on Twitter but didn’t expect 15,000 people to join in. At the most we expected 1,000”, said Oleg Brega of the activist group Hyde Park.

Police deployed tear gas and water cannons, and fired blanks into the crowd. The rioters threw stones at the riot police and took control of the parliament building and presidential office. A bonfire was built out of parliamentary furniture and all windows below the 7th floor were broken.

Approximately one hundred protesters and 170 police officers are reported as injured. There have been conflicting reports as to whether a female protester died during the altercation.

193 protesters “have been charged with looting, hooliganism, robbery and assault,” said an Interior Ministry spokesperson. This announcement sparked another protest by those demanding the release for those detained.

There is wide speculation about who was to blame for the rioting.

President Vladimir Voronin has expelled the Romanian ambassador from Moldova, blaming Romania for the violent protests. “We know that certain political forces in Romania are behind this unrest. The Romanian flags fixed on the government buildings in Chisinau attest to this” said Voronin. “Romania is involved in everything that has happened.“ Voronin also blamed the protests on opposition leaders who used violence to seize power, and has described the event as a coup d’état.

Protesters initially insisted on a recount of the election results and are now calling for a new vote, which has been rejected by the government. Rioters were also demanding unification between Moldova and Romania. “In the air, there was a strong expectation of change, but that did not happen”, said OSCE spokesman Matti Sidoroff.File:Dorin Chirtoaca.jpg

“The elections were fraudulent, there was multiple voting” accused Chi?in?u mayor Dorin Chirtoac? of the Liberal Party. “It’s impossible that every second person in Moldova voted for the Communists. However, we believe the riots were a provocation and we are now trying to reconcile the crowd. Leaders of all opposition parties are at the scene,” said Larissa Manole of the Liberal Democratic Party of Moldova.

The Organisation for Security and Cooperation in Europe (OSCE) proclaimed the PCRM to have won 61 seats in initial counts, enough to guarantee a third term in power for Voronin, who has held the position since 2001. But the Central Election Commission has received evidence of election violations, according to RIA Novosti, and upon recounts conducted of disputed polls, the commission reported that the Communists achieved 49.48% of the Moldovian vote, giving them 60 parliamentary seats — one short of the total needed to win the presidential election. “The electoral commission also granted opposition parties permission to check voter lists, fulfilling one of their chief demands,” said Yuri Ciocan, Central Election Commission secretary.

Voronin will step down in May, however his party could elect a successor with 61 parliamentary seats without any votes from outside parties as well as amend the Constitution. With the PCRM garnering 60 seats, the opposition will have a voice in the presidential election for a new successor.

The western part of Moldova was a part of Romania from the Romania’s independence until the region was detached by the USSR in 1940 to form the Moldavian Soviet Socialist Republic. On independence in 1990 the country sought union with Romania but the eastern, Russian- and Ukrainian-inhabited areas of the country declared themselves independent from Moldova and formed the state of Transnistria and movement toward union was halted.

Moldova is Europe’s poorest country, where average income is less than $250 (£168) a month. The country’s neighbours are Romania and Ukraine. Romania is a European Union (EU) state.

Wikinews held an exclusive interview with James Burns, one of the candidates for the Libertarian Party nomination for the 2008 U.S. presidential election.

Burns, the former chairman of the Nevada Libertarian Party, was asked if he thinks he has a good shot at winning the Libertarian nomination and ultimately the presidency. He replied, “My chances of winning are not all in my hands. I shall do my best, but it comes down to what others will do. What will you do?”

When asked about America’s shrinking middle class he said, “The economic policies of the US government are the cause our troubles. When I am President, the only economic policy I shall pursue is to be frugal with the funds of the United States.”

Burns believes that the President “is not ‘the leader of the free world,’ rather….a person who attempts to protect our rights to life, liberty, and the pursuit of happiness.”

Ford offers US$78 million for Romanian auto plant

Ford Motor Company, the U.S. car maker, will reportedly pay €57 million (US$78 million) for a 72.4 percent stake in the Romanian assembly plant Automobile Craiova, a Romanian official said Friday.

“The offer of Ford Motor Company for a 72.4 percent stake is €4.1556 per share or €57 million overall,” said Sebastian Vladescu, head of the State Property Agency (AVAS), after opening Ford’s improved offer. Vladescu added that the contract may be signed on September 12, during the auto show in Frankfurt.

The Romanian government bought back the Craiova-based car maker from Daewoo Motors, in late 2006 for US$51 million. As the Korean company was bankrupt, the government had to pay another $10 million for debts stemming from past loans. Ford is the only bidder for the purchase of the factory.

According to Washington Post, many auto-part makers have set up in the new European Union member country, attracted by cheap labor, favourable tax rates and the rising output of Renault’s Dacia plant. The vice president of Dacia, Constantin Stroe, said that the price Ford offers is not important. “It’s important to have the factory working as soon as possible”, he added. “With this production facility, Romania will become an important auto production center in Europe”, concluded Stroe, cited by HotNews.

Iranian International Master Dorsa Derakhshani discusses her chess career with Wikinews

In February 2017, the Iranian Chess Federation announced two teenage chess players, Dorsa Derakhshani and her younger brother Borna Derakhshani, were banned from representing the national team. The federation announced their decision although Dorsa Derakhshani had previously decided and informed the chess federation she did not wish to play for Iran.

Dorsa Derakhshani is currently 21 years old and holds the International Master (IM) as well as Woman Grand Master (WGM) titles. Her brother, Borna, plays for the English Federation and holds the FIDE Master title.

Dorsa Derakhshani was banned since she did not wear a hijab, an Islamic headscarf, while competing at the Tradewise Gibraltar Chess Festival in January 2017. Under the laws of Islamic Republic of Iran, hijab is a mandatory dress code. Her brother Borna Deraskhsani was banned for playing against Israeli Grand Master (GM) Alexander Huzman at the same tournament. Iran does not recognise the existence of Israel, and previously, Irani athletes have avoided playing against Israeli athletes.

Four killed, dozens injured in southern Thailand bombings

Four people were killed and about two dozen injured in a bombing at a crowded market in Saba Yoi, Songkhla Province, Thailand.

The day before, a series of bombings in Songkhla’s main city Hat Yai injured 13 people. Police are investigating those attacks, which occurred at around 9 p.m. (1400 GMT) on Sunday, when seven coordinated explosions went off at stores, hotels and restaurants in a city that is popular with tourists.

In Monday’s bombing, the dead were two women and two girls, ages 4 and 8. The bomb, which exploded shortly after 4 p.m. local time (0900 GMT), was hidden in a motorcycle parked in front of the market next to a railway station.

Authorities have not concluded if the blasts are linked to the ongoing insurgency by Muslim separatists in southern Thailand. The past year has seen an escalation of violence, with almost daily fatal shootings of civilians and frequent ambush attacks on soldiers. Since early 2004, more than 2,200 people have been killed, mainly in the southernmost provinces of Yala, Pattani and Narathiwat. Thailand is predominantly a Buddhist country, but in those three provinces, the majority of residents are Islamic.

Council for National Security chairman General Sonthi Boonayaratkalin said he believed Sunday night’s bombings were only meant to cause a disturbance. Other officials compared the Hat Yai blasts to the Bangkok New Year’s Eve bombings, which they say were caused to create political tensions, though in those blasts, three people were killed.

Business analysts believe Sunday night’s bombings will hurt Hat Yai’s tourist trade, which has been struggling since a spate of bombings in 2005, including one that killed two people at Hat Yai International Airport, as well as blasts in a department store and hotel, with about 70 people wounded. In September 2006, four people were killed in a series of bombings in Hat Yai.

The latest bombings come at a tense time for Thailand. In the nation’s capital, Bangkok, security forces are on alert ahead of a court ruling expected on Wednesday that could lead to the dissolution of the former ruling Thai Rak Thai party and the main opposition Democrat Party. Since a military-led coup d’état last year, in which prime minister and Thai Rak Thai leader Thaksin Shinawatra was ousted, all political activity has been banned by the junta.

Last week, King Bhumibol Adulyadej made a rare televised address as he granted an audience to the administrative court judges. He urged them to use care in their verdict. “You have the responsibility to prevent the country from collapsing,” he told them.

Authorities believe supporters of the political parties may cause trouble if they are displeased with the verdict.

Meanwhile, the nation’s constitution is being rewritten, and Buddhists are demanding that Buddhism be made the national religion, a move that experts believe will lead to an even bigger increase in violence in Muslim-dominated southern Thailand.

Australian swim team pulled from Rio training pool when water turns ‘soupy’

Concerns about water quality at the 2016 Rio de Janeiro Olympic Games have expanded to include the inside training pool: top Australian swimming coach Michael Bohl moved his Olympic athletes from the main training pool on Thursday citing fear of infection.

The team had a pre-booked session in the training pool where they would have practiced uninterrupted. However, during the session the water in the pool turned, as Bohl described, “cloudy” and “soupy looking”. Concerned about his athletes’ health, he moved them from the training pool to the busier, but cleaner, main competition pool.

Bohl took his concerns to officials and was told the matter would be looked into.

This comes off the back of other water concerns in Rio, particularly in the Guanabara Bay venue for outdoor water events. An Associated Press-commissioned study found Rio’s Olympic waterways contained as much as 1.7 million times worse viral levels than the emergency threshold in Europe or the US. As a result, athletes were advised to keep their mouths closed and avoid putting their heads underwater or risk falling ill.

Swimming events at the 2016 Rio de Janeiro Olympic Games are to begin today.
